TERMS OF SERVICE

These Terms of Service govern your use of the Maria The Notary LLC website and services. By requesting, scheduling, or receiving services, you acknowledge that you have read and agree to these terms.

1. Services Provided

Maria The Notary LLC provides:

• Mobile general notary services
• Real estate and loan-signing services
• Nonlegal document and administrative support
• Paralegal support for attorneys and law firms under attorney direction

Mobile services are primarily available throughout Westchester, Rockland, and Bronx Counties. Availability in other locations is determined on a case-by-case basis.

Services described as “coming soon” are not available until Maria The Notary LLC confirms otherwise.

1. Notarial Services

Maria The Notary LLC performs notarial acts authorized under New York law. A notarization verifies certain facts relating to the signing, such as identity, acknowledgment, willingness, or the administration of an oath or affirmation. Notarization does not establish that a document is accurate, valid, enforceable, or legally binding.

Maria The Notary LLC is not responsible for preparing, selecting, or explaining legal documents or determining which notarial certificate a document requires. The signer must obtain those instructions from the document’s issuing organization, receiving agency, or a licensed attorney.

1. No Legal Advice or Representation

Maria The Notary LLC is not a law firm. Maria Cotto is not an attorney and does not provide legal advice or legal representation.

Questions concerning the preparation, meaning, legal consequences, enforceability, or suitability of a document must be directed to a licensed attorney before the appointment.

Paralegal services are provided to attorneys and law firms under attorney direction. Nonlegal administrative and document-management support may also be provided to title companies, real estate professionals, and other businesses. Services will not include the independent preparation of legal documents for members of the public.

1. Appointment Requirements

The person requesting services is responsible for providing complete and accurate appointment information, including:

• The appointment location
• The type and number of documents
• The number of signers
• Any witness requirements
• Printing or scanback requirements
• Any deadlines or special instructions

Each signer must personally appear before the notary and present satisfactory identification as required by New York law.

Documents should be complete and ready for notarization. Documents containing blank spaces or missing material information may not be notarized.

Unless instructed otherwise by the document’s issuing or receiving organization, documents should not be signed before the appointment when the signature must be witnessed or an oath must be administered.

1. Right to Refuse or Stop a Notarization

Maria The Notary LLC may refuse or discontinue a notarization when:

• A signer cannot provide satisfactory identification
• A signer does not personally appear
• A signer appears unwilling, unaware, coerced, or unable to communicate directly with the notary
• The document is incomplete or contains blank spaces
• The required notarial wording is missing and authorized instructions are not provided
• The requested act is prohibited by law
• The circumstances raise concerns about fraud, misconduct, safety, or impartiality
• The signer or requesting party asks the notary to provide legal advice or perform an unauthorized service

Refusal to perform an improper or unlawful notarization does not constitute a breach of these terms.

1. Fees and Pricing

New York statutory notarial fees are charged separately from travel, printing, document handling, loan-signing, administrative, and other service charges.

Current starting prices include:

• Mobile notary appointments: starting at $40, plus applicable statutory notarial fees
• Seller closings: starting at $150
• Purchaser closings: starting at $200
• Refinance closings: starting at $175
• HELOC closings: starting at $150
• Paralegal and legal administrative support: starting at $65 per hour

Final pricing may depend on travel distance, appointment time, document volume, printing, scanbacks, number of signers, waiting time, witnesses, parking, tolls, urgency, and the complexity of the assignment.

A quote will be provided before the appointment is confirmed. The confirmed written quote controls if it differs from general website pricing.

Assignments received from title companies, signing services, attorneys, or other business clients may be governed by separate written agreements or assignment confirmations.

1. Travel and Additional Charges

Standard closing fees include travel within 15 miles of Yonkers unless otherwise stated in the confirmed quote.

Travel beyond the included service radius may be charged at $1.50 per additional mile, calculated one way. Parking and tolls are charged at their actual cost.

Additional charges may apply for:

• Evening, weekend, holiday, or rush appointments
• Required witnesses
• Large document packages
• Printing or reprinting
• Scanbacks
• Additional signers or signing locations
• Extended appointments
• Return visits
• Excessive waiting time

The first 15 minutes of waiting time are included. Additional waiting time may be charged at $25 for each additional 15-minute period.

1. Payment

Payment is due at the time services are provided unless another arrangement has been confirmed in writing.

Accepted payment methods will be communicated before the appointment. Clients are responsible for any agreed travel, printing, parking, toll, waiting, or cancellation charges.

Business clients operating under separate written payment terms will be invoiced according to those terms.

1. Cancellations and Rescheduling

Appointments canceled or rescheduled at least 24 hours in advance will not incur a cancellation charge unless documents have already been printed or other approved expenses have been incurred.

The following charges may apply:

• Cancellation or rescheduling within 24 hours: $25
• Cancellation after documents have been printed: up to $50
• Cancellation after travel has begun: $75, plus applicable tolls and parking
• Return appointment caused by missing identification, an absent signer, incomplete documents, or incorrect instructions: a new travel or appointment charge

Only the highest applicable cancellation charge will be imposed; cancellation charges are not cumulative. Approved printing, parking, toll, and other out-of-pocket expenses may be added.

A loan-signing or business assignment governed by a separate written agreement will follow the cancellation and payment terms of that agreement.

1. Incomplete or Unsuccessful Appointments

Travel, printing, waiting, and other service charges may remain payable when an appointment cannot be completed for reasons outside the control of Maria The Notary LLC, including:

• Unacceptable or missing identification
• An absent or unwilling signer
• Incomplete or incorrect documents
• Missing witnesses
• Incorrect appointment information
• A signer’s inability to complete the transaction
• Instructions that would require an unauthorized or unlawful notarial act

Maria The Notary LLC does not guarantee that a receiving agency, recorder, financial institution, court, title company, or other organization will accept a document.

1. Document Handling and Confidentiality

Maria The Notary LLC uses reasonable measures to protect documents and personal information received while providing services.

Clients should not submit Social Security numbers, financial account numbers, medical information, identification documents, or other sensitive information through the website’s general contact form.

Information is collected, used, stored, and disclosed in accordance with the Maria The Notary LLC Privacy Policy.

1. Loan-Signing Services

During a loan signing, Maria The Notary LLC presents documents, indicates where signatures or initials are required, administers required notarial acts, and follows instructions supplied by the hiring organization.

Maria The Notary LLC does not explain loan terms, provide financial or legal advice, negotiate transaction terms, or answer questions reserved for the lender, title company, settlement agent, or attorney.

Questions concerning interest rates, fees, payment amounts, rescission rights, title matters, or the legal effect of the transaction must be directed to the appropriate authorized professional.

Website content is provided for general informational purposes. It is not legal, financial, tax, or insurance advice.

Maria The Notary LLC makes reasonable efforts to keep website information accurate but does not guarantee that all content will always be complete, current, or error-free.

Third-party links are provided for convenience. Maria The Notary LLC is not responsible for the content, availability, security, or privacy practices of third-party websites.

1. Intellectual Property

Unless otherwise stated, the website’s original text, branding, logos, graphics, and other content belong to Maria The Notary LLC and may not be copied, reproduced, distributed, or used commercially without written permission.

1. Limitation of Liability

To the fullest extent permitted by law, Maria The Notary LLC will not be liable for indirect, incidental, special, or consequential damages arising from the website or services.

Maria The Notary LLC is not responsible for delays, rejection of documents, recording problems, missed deadlines, financial losses, or other consequences caused by incomplete or inaccurate information, client-provided documents, third-party instructions, delivery services, government agencies, financial institutions, or circumstances outside its reasonable control.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited.

1. Governing Law

These terms are governed by the laws of the State of New York. Any dispute relating to these terms or the services provided will be handled in a court of appropriate jurisdiction located in Westchester County, New York, unless applicable law requires otherwise.

1. Changes to These Terms

Maria The Notary LLC may update these Terms of Service as services, pricing, or legal requirements change. The revised terms will be posted on the website with an updated effective date.

Terms in effect when an appointment is confirmed will generally apply to that appointment unless the parties agree otherwise in writing.

1. Severability

If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.
